CG-ACA-101 · Warns · Citation checked against stored text
A qualified health plan issuer, and its employees, agents and representatives, may not use marketing practices or benefit designs that have the effect of discouraging enrollment by people with significant health needs. Saying a plan is built for healthy people, or steering away people with chronic or costly conditions, can have that effect. Applies to marketplace plan issuers and the agents marketing for them.
Source: 45 CFR 156.225(b)
Safer wording: Describe the plan by what it covers, its network and its cost. Do not say it fits healthy people or that people with ongoing medical needs should look elsewhere.
